Forty-Two year old Ahmed Dolye Kamara in Makeni, has been imprisoned for his attack on social media of Mohamed Sallieu Jalloh and the entire Fullah community. The victim, Jalloh took to the witness stand before Magistrate Sahr Kekura for Preliminary Investigation on two counts of Cyber Stalking and Misuse of Devise, contrary to the Cyber Laws of Sierra Leone.
It was alleged on the charge sheet that sometime between the 1st to the 22nd of December 2021, through social media via WhatsApp, recklessly and intentionally sent a grossly offensive video message against the Fullahs which was seen as indecent, obscene, and menacing on their character as a people which has the tendency to have caused p danger, obstruction, insult, injury, criminal intimidation, enmity, hatred, ill will and needless anxiety to the Fullah community in Sierra Leone and abroad.
In count two, the police alleged that the accused intentionally or without authorization procured for use, possessed, offered to supply and distribute video messages against the Fullah tribe for the purpose of committing an offense and of insulting and provoking.
Led in examination-in-chief, the complainant recognized the accused in the dock as someone he saw on a video sent to him on a social media platform.
He said that between 1st and 22nd of December 2021 at night, one Abdul Sow sent a video to him with a mobile phone on WhatsApp.
Upon receiving the video, he opened it and detected a lot of invectives with the photo of the accused referring to the Fullah people all over the world.
The Complainant said that the accused further referred to them as bastards.
Leading further by prosecutor Dwight Macarthy, the complainant said that he went to the Police Station where he was asked to make a statement after the report.
The Complainant produced the said video in court for both prosecuting and defense counsel to look at it.
On reaching that stage M. Sheriff, counsel defending the accused, applied for bail for and on behalf of his client. He said his client is a family man, and if granted bail he would not interfere with the witness neither jump bail. He backed up his application by citing section 79 of the Criminal Procedure Act of 1965.
The Prosecution relied on the affidavit in support to oppose bail.
Having heard from the defense, Magistrate Sahr Kekura did not admit the accused to bail and adjourned the matter to the 18th of January 2021.
