Police Sergeant Issa Kamara on Monday, August 29, 2022 before magistrate Mark Ngegba of Pademba road court No1 tendered harmful implements that were allegedly used by the accused persons to rob the complainant at Wongor Mining company.
The accused persons Amadu Bello Mohamed Thailey, Augustine Korfuma aka councilor, Boibe Gibnia Conteh and Daniel Samura are before the court on four counts of conspiracy to commit a felony contrary to law, robbery with aggravation, assault occasioning actual bodily harm, carrying offensive weapon without lawful authority and reasonable excuse, all contrary to the laws of Sierra Leone.
The particulars of offence for count one state that, all the accused persons on Friday, July 1, 2022 at Wongor Mining company in Kumoroh village in the Nimikoro chiefdom, Kono District conspired with other persons unknown to robbery with aggravation.
Counts two states that the accused persons on the same date and place being armed with cutlass and scissors, robbed Ruiping Chen, a Chinese national, a black bag containing
4,498.54 gram of concentrate of gold substance valued at US$38,000 (NLe 522,500/00), and at the same time or immediately after the said robbery, did use personal violence to the said Ruiping Chen.
The police further allege on count three that, the accused Daniel Samura on the same date and place assaulted Ruiping Chen in a manner thereby occasioning him actual bodily harm.
Whiles counts four indicates that the accused Daniel Samura on the same date carried offensive weapon in a public place to wit cutlass and a scissors without lawful authority or reasonable excuse.
The witness detective police sergeant 8576 Issa Kamara in further evidence said he is attached to the exhibit office at CID headquarters.
According to him, his duties are to ensure the safe keeping of all exhibit brought in the office related to matters reported for investigation
He recalled, July 4, 2022 when DPC 14875 Kumba E, attached at the breaking and larceny syndicate handed over to him one locally made cutlass, one old scissors with orange handle, one assorted colour cold cap, two short gun cartridges.
The said the exhibit were register in the court exhibit book which he said had since been in police custody.
The exhibits were produced and tendered in court to form part of the prosecution’s case.
During cross-examination by lawyer Jengo on behalf of all the accused persons, the witness said it was DPC Kumba that handed over the said exhibit to him.
Defense counsel lawyer Jengo in reply requested for 10 days to do his no case submission.
He however, renewed his application for bail, adding that prosecutor had closed their case, and that the issue of interference has been dealt with in that aspect.
DSP Isatu Gbassay Fofanah in reply objected to bail due to the the serious nature of the offenses charge.
Magistrate Ngegba however, granted bail to all the accused persons in the sum of Nle500,000 and two sureties each, adding that one of the surety should be above 40 and must be gainfully employed in a reputable institutions with proof of employment. He said the surety should also produce a title deeds valued Le400 million.
The bail should be approved by the Master and Registrar of the high court. The matter was adjourned to September 13, 2022.
However, the accused persons were unable to meet the said bail conditions and were remanded in prison.
