Sierra Leone: Magistrate commits case of Murder to High Court

Magistrate Joseph Tobby, who presides at Court No 2 in Kenema, has committed to the High Court for trial after deciding on the completion of Preliminary investigation in case in which one Foday Ansu, alias Badyai, 20, a farmer of Largo village in the Kenema District, is accused of unlawful killing. According to the allegations on the police charge sheet, on Thursday February 20, 2020, at Largo Village, Nongoma Chiefdom, Kenema, Ansu murdered one Mbaimba Lamin.

He had initially been charged with wounding with intent, wounding and assault occasioning actual bodily harm, at the commencement of the preliminary investigations at the Magistrate Court No. 2 in Kenema, but the victim Mbaimba Lamin died during the course of the preliminary investigation, causing the police to add Murder to the charges which had been levied against the accused.

The cause of Lasmin’s death from the medical doctor’s report was as a result of wounding. The matter has been committed to the high court for the next criminal session.

In the same court room, a case involving one Ibrahim Musa Ngombu was committed to high court by Magistrate Tobby for sexual penetration of a child contrary to section 19 of the sexual offences Act No 12 of 2012.

The accused on diverse dates between February 2020 to August 2020 at Lekpetieh Kenema allegedly sexually penetrated a 16-year-old girl.

The case against both accused persons was prosecuted by Inspector A.M Teh and Sgt. 4654 Bakarr Watta attached to the legal and justice support department of  the Kenema Police Division.
