A bike rider Ibrahim Mohamed Kamara,29, was committed to the high court for further trial by Magistrate Sahr Kekura of Pademba Road Court No 1 for the alleged murder of Alpha Sankoh.
The accused is before the court on one count charge of murder contrary to law.
According to the police, the accused on Saturday, January 21, 2022 at Ro-Theren village, Romende chiefdom, PortLoko District murder Alpha Sankoh.
Magistrate Kekura, in his ruling, said the prosecution in a bid to prove its case beyond reasonable doubt against the accused person, called six witnesses including the formal witness, exhibit Clerk and the scene of crime officer who tendered various exhibits. He said that accused himself only cross-examined PW1,PW2,PW3 and PW4 but didn’t cross-examined PW5 and PW6.
Magistrate Kekura further that his duties is to examine the evidence adduced before the court and if the prosecution establish sufficient evidence against the accused person the matter will be committed to the high court for trials, but if there is no sufficient evidence, the accused will be discharged pursuant to section 118 of the Criminal Procedure Act No.32 of 1965.
The magistrate examined the evidence in its entirety, including the statement the accused made to the police in which he admitted that he harmed the victim Alpha Sankoh, now deceased, by hitting him with a cutlass twice on his head and chin which led to the demise of Alpha Sankoh.
“In view of the confessional statement made by the accused person to the police including the exhibit R1-11 which is the photographic album that contains the remains of the deceased Alpha Sankoh, the death certificate Exhibit and the Exhibit C1-4, have convinced me that the prosecution has established sufficient evidence against the accused for him to stand trials at the high court,” the Magistrate said.
“I therefore commit the matter to the high court for trials,” he ruled.
Magistrate Kekura also refused to admit the accused on bail.
Sergeant 9939 Mohamed Lahai prosecuted the Matter.
