Justice Brown-Marke Cautions Court Officials

Supreme Court Judge presiding the May 2022 Criminal Sessions, Justice Nicholas Browne-Marke has cautioned court officials to refrain from denying accused persons bail after magistrates and judges had given them bail.

He said that it is a fact that a host of accused persons have been behind bars even though Magistrates or Judges have granted them bail.

 Justice Browne Marke said that after bail is been granted to an accused, the officials in charge must ensure they perform their own side of the task.

He noted that an accused should not be held in custody after he had met the laid down bail criteria.

He said noted that some court officials, according to all allegations, had been denying accused persons bail, despite decision by the Magistrate or Judge to admit them to them.

He noted that the sometimes the process of fulfilling some bail conditions has been a problem for some ccused persons and their sureties.

Justice Nicholas Browne-Marke noted that they will not take it lightly with any individuals stall the justice process.

He said if any official flout his order, such official will take responsibility of his or her actions.
