Our client has been denied quality representation – LAJ’s Lawyer

He said that since the arrest of the accused, the legal team and other people have been denied unfettered access to the accused in custody. 

He said this while making an application for bail for the accused whom he claimed is visibly sick and was seen limping when entering the court room and needs urgent medical care.

He submitted that the accuse has comported himself so far in the ongoing Preliminary Investigation (PI) and promised he will continue to comply accordingly.

But State Counsel Y. I Sesay opposed to the bail application.

Before the application for bail, PW2 Musa Mansaray continued testimony while he was cross-examined by defense Lawyer Maddieu Sesay.

He (the witness) said haven recorded his statement to the police on Sunday, June 12, 2022, he was asked to take a picture of himself and printed it out which he did and was then issued with a medical report.

He said that during the said incident, he was at the side of one of the machines at the fuel station.

When the witness was asked whether the accused said a word immediately after stepping out of the vehicle, Musa said no. He said that the accused leaned at the back of the vehicle for a while before telling Francess she was a ‘fucking public servant’.  The witness said it was the accused and Bugu that scolded him during the scuffle.

The accused, the witness said, held him with one hand and banged him with the other, adding that when asked whether he told the police that it was the accused who banged him, Musa responded in the negative, adding that the police did not ask him for such information. 

The witness confirmed that the phone which was given to someone to take a snapshot of him on the day of the incident has only been used for about four months. When asked whether the said phone recorded details including time and date when the picture was taken, Musa said yes, adding that the date and time on the phone are correct.

The witness reiterated that it was the accused LAJ that punched him in the face after defense counsel M. Sesay put it to the accused that he didsn’t know who punched him.

At this stage when asked to go to the details of pictures gallery to check the details of the picture, Musa said it’s June 22, 2022, and at 11:54am, but however the details according to defense Counsel M. Sesay doesn’t show the date of the incident.

However, defense Lawyer M. Sesay requested that the safest place for the phone to be kept was the court considering the seriousness of the matter before the court for fear of montage, but state counsel Y.I Sesay opposed to it while invoking section 59 of the Criminal Procedures Act of 1965 about the restitution of the said phone which has been marked as exhibit A.

The accused was remanded in custody while the matter was adjourned to June 5, 2022 for further hearing.
