Sierra Leone: Defense to make no-case submission in Tombo riot case

The defence counsel for the accused persons in the Tombo riot case, has told the court that he will proffer a written no case submission to the Court. The eighteen accused persons were  arraigned on Wednesday September 16, 2020 before Magistrate Hannah Bonnie of Court No.1 on Pademba Road.

Police prosecutor, Inspector I. G. Fofana acknowledged receipt of the no-case submission, and promised that she will respond to it at the next adjourned date.

Magistrate Bonnie adjourned the matter to September 30,  2020, whiles all accused persons remain on bail.

Police alleged that, on Wednesday May 6, 2020, at Tombo Village the accused persons conspired together with some other persons unknown to commit the felony of malicious damage. Police also alleged that they maliciously set fire to the Tombo Police Station, and a hospital.

They further alleged that the aforementioned persons maliciously damage one steal door valued at Le 800,000, 3 windows valued at Le 2,000,000 twenty-four window glasses valued Le 480,000, 2 big glasses on a glass door valued at 160,000, 2 double wooden doors valued at Le 300,000 and 1 single wooden door valued at Le 400,000. The police are claiming that the value of the property destroyed is Le 5,740,000 million seven hundred and forty thousand property of Michael Benka.

They were charged with Conspiracy to commit a felony contrary to law, malicious damage contrary to Section 51 of the Malicious Damage Act of 1861, and Setting fire to a public building contrary to Section 5 of the Malicious Damage Act.
